PALMDALE – A suspected DUI motorist was killed in a deputy-involved shooting early Sunday morning outside a Palmdale fast-food restaurant.
The incident began just before 3 a.m. Sunday, Dec. 20, in the parking lot of the Taco Bell, located on the 37900 block of 47th Street East in Palmdale, according to a news release from the Sheriff’s Information Bureau.
“The call came from employees of a fast-food restaurant who reported that a vehicle had collided into the business, near the drive-through area, and the driver appeared to be unconscious,” the sheriff’s news release states.
“When deputies arrived, they made contact with the suspect-driver, and based on initial observations, they began to conduct a driving under the influence investigation,” the news release states.
The suspect was placed in the rear of a patrol car, and he jumped out as he was about to be handcuffed and began to fight a deputy, according to the sheriff’s news release.
Other deputies came to aid and the fight was taken to the ground.
“At some point during the fight, the suspect grabbed ahold of the deputy’s weapon,” the news release states. “The deputy immediately attempted to retain his weapon while he advised the other deputies that the suspect was trying to remove his weapon.”
The deputies attempted to subdue the suspect, but he refused to let go of the deputy’s weapon, according to the sheriff’s news release.
A deputy-involved shooting occurred, the suspect was struck by gunfire and the fight stopped, sheriff’s officials said.
The suspect was transported to a local hospital where he was later pronounced dead.
The deputies involved in the fight suffered cuts, bruises and abrasions, sheriff’s officials said. It was not immediately known if any deputies were transported to the hospital.
“During the course of their investigation, detectives located a blue-steel pistol and a large baggie of marijuana located inside the suspect’s vehicle,” the sheriff’s news release states.
There is no further information at this time and the investigation is ongoing.
The suspect’s identity is being withheld pending next of kin notification.

UPDATED 12.21.15: The man shot dead by deputies has been identified as 30-year-old Leroy Browning of Palmdale, according to an updated news release from the Sheriff’s Information Bureau. I do agree that this guy was a shady character. I think the argument is really that incompetence leads to unjustified shootings then a standard defense of he grabbed my gun. If a trained officer acts irresponsibly and someone ends up dead, what should be the penalty? Not saying that’s what happened here, but it’s a tough question. He’s supposed to be able to arrest someone without killing them, even if they fight him. In this case they outnumbered the guy too.

I only met him in passing I spoke and he spoke back talking about my grandkids and his kids. My kids know i speak to anyone and will hold conversation like I have known you for years. I am saddened this young man lost his life. It could have been any of ours. I never believe what is said about someone who just happens to lose their lives in a police shooting. I just hope that they are not twisting the facts about what really happened because now, they are sending cops to jail and are finally holding them accountable.
I live a few blocks from were the shooting occured and on Sunday morning, while i was refilling my 5 gallon water jugs across from taco bell in the tom’s burgers shopping mall area, i noticed cops going around all the stores in the shopping mall area looking for video footage.
In Chicago, a similiar inccident occured where the cops shot an unarmed man but they all claimed that the man was armed and that was the reason they killed him. These knuckleheads then went around looking for video footage and found a burger king that caught everything on camera and the police officets ereased all the footage.
Luckily, a civilian caught the shooting on camera and turned out that the man that they claimed was armed, was unarmed, the shooting was unjustified, and 9 cops are now facing charges.
So no….it is not race baiting. The people have lost trust in the police force, thanks to their own piss poor judment calls that they keep making.
That said, the police better handle this invetigation the right way, if not this case is going straight to the federal level.

I only hope at least one of them had a body camera that will show footage of how this innocent young individual was not unconscious, not complying, yelling some choice threats, and the officers involved yelling for him to stop, communicating the threat level to each other and finally taking appropriate action. I am sure he was not just sitting there unconscious and was shot.
I only wish someone like yourself could be put through some situations to see how you would react. It must be easy to sit there and armchair quarterback everything from the safety of your own living room.

Leroy Browning was a thug and a menace to the community. He was suspected of drunk driving and the deputies found a pistol and a large baggie of marijuana in his car. He was wanted on a warrant in connection with an Antelope Valley robbery and shooting.
Mr. Browning was convicted in 2008 for possession of a loaded firearm and sentenced to a year in jail and he was facing court proceedings on a 2014 charge in Los Angeles of felony hit-and-run, felony evading of a peace officer and possession of a firearm by a felon.
Mr. Browning was wanted by the Palmdale Sheriff’s Station detectives in connection of a home invasion robbery in which a person was shot. He was charged with armed robbery, burglary and assault with a deadly weapon for a July 12 incident. A warrant was issued for his arrest.
Mr. Browning knew he was going to jail and possibly prison. I am not surprised he fought the deputies.

I’ve had a couple very useful conversations lately, one with a deputy and one with a captain.
I’m not really convinced that training is the problem though. Deputies ignoring the training is more the issue, I suspect. Take this situation. I would bet all the cash in my pocket that the deputy that went to put the cuffs on this guy didn’t follow anything like any process that he had been taught. The outcome is telling. The department training focuses so heavily on officer safety that there is no way they are teaching a procedure that ends up with a drunk guy grabbing an officer’s gun.
In my opinion the problem is an issue of accountability. The badge lickers in the public are all about “all is well that ends well, and we don’t care about dead people as long as they’re “bad guys.” I know our local captain doesn’t feel that way, but I suspect a whole lot of our deputies do. The question is whether the culture of the sheriff’s station drives towards “Just how the [deleted] did you let that guy get hold of your gun? Why couldn’t you do such a simple task right? Now we have the guy’s blood on our hands because you are such a [deleted],” or towards “Hey, enjoy your paid leave, good shoot, let’s do it again sometime.”
Regretfully, at this point I don’t have much confidence that the new sheriff or our captain have the horses to direct that culture in a positive direction, though I could be happily wrong about that. If I am not I have the highest of hopes that we can get things reformed without the trial by fire that the LAPD and numerous other similarly failed law enforcement organizations have required.

That mentality is why people get themselves in trouble… A cop might be giving you legal orders but you might think they are not legal. You resist a lawful or unlawful order and fight with cops and you escalate it to lethal force then you can end up dead. If it was lawful and you don’t escalate it to lethal force the you would end up with a criminal record or if it was unlawful then you would end up getting paid in court… Resisting a police officer is savagery in a time where we have more intellectual options like suing in court.

Captain Don Ford, of the Palmdale Sheriff Station will release a full report and an autopsy report as soon as its available, if it is Not then the report will be NOT made available to the public unless it is asked for by some LA Times reporter just like it happened with the young couple that was killed by deputy Kamal Jannah, of the Palmdale Sheriff Station, remember that really awful accident back on December 13, 2013 deputy Jannah was found to be at fault. It took both the CHP and the Palmdale Sheriff Station two years to release a report and that’s only because a reporter asked for them, otherwise we would still be in the dark about that accident. Any law enforcement office that goes through something like this, when they are not at Fault they are quick to release the report or reports but when there is something to hide or the incident is not 100% clear then they tend to hide or make the reports not available. Does anyone remember how many deputy involved shootings have happened in the past in both Palmdale and Lancaster? Has any one seen a report being release either here on the AVTIMES or the VALLEYPRESS? Nope we haven’t, the only time I remember seeing a report and an autopsy report here on the AVTIMES, was some guy that was shot in his garage somewhere on Ave R and it turned out that when he was shot, he was shot in the back facing away from the deputies. SO? Yup there you have it, lets wait and see what happens? Lets assume for a minute that the deceased Mr. Brown was the worst of the worst and for some reason deserved the death penalty, but maybe he was not he was just some one that made some really bad mistakes in the past, he still needed to be brought to justice and be punished for what he had done.

You have a guy that just hit a building and they believe was drunk. A guy who had just broken the law by allegedly driving under the influence with marijuana and a gun in the car. The gun being a huge problem because he’s already a felon and thats a big no no. On top of all that, he’s got a warrant out for his arrest for being involved in a home invasion where somebody was shot. Despite his size and supposed back injury, I’d say he knew he was up the proverbial [removed] creek and didn’t want to be arrested. That’s pretty good motivation for a small guy to fight back and get the drop on deputies not expecting it to happen.

Tim, that ‘little guy with back problems’ could have come to, hopped up on adrenaline. Very likely since he knew he was wanted. Have you ever wrestled? It is not always the big guy that wins. Not to mention the advantage of surprise, granted an officer really should never be caught off guard yet it happens so often that it must be part of the human condition.
In short, you were not there. I doubt any of the commenters were on scene. Everything stated in the comments is hearsay. The incident is being investigated by several parties and eventually a report can be obtained by the family and maybe the public.

One more time…that “caught by surprise” officer will bear no accountability for letting that happen. That isn’t a result of “the human condition,” it’s a result of the “if things go bad we can just shoot someone without any consequences” culture law enforcement in America has developed. Thousands of years of debate… it is still the same. Humanity has tried prison in many different styles, tried education, tried drug therapy , shock therapy, counselling, threat of death. Some people can not be fixed, or cured. The final option is death. The reason we have prison with therapy, then prison, then life, then death is to allow our minds to excuse the eventual death of a perpetrator through progression of charges.

There is enough information out there that a person has to be stupid to not know the dangers of drinking/using drugs and driving. It is that person’s disregard for others, not the substance that causes problems.
As for getting hooked on a substance. Again unless they grew up in some void of information, they know the risks involved regarding addiction. They just feel the rules don’t apply to them. That it could never happen to them. That substance didn’t just jump into their hand, they put it there.

I did know the guy personally in high school, and if anyone knew him knew there were multiple sides to Leroy. I know it’s been years since high school so granted he may have experienced growth and change, maybe not. But I do remember him being a cool and mellow individual overall, whom should you make mad, watch out. Anyone saying there’s no way a 5 foot 3 guy could have held his own against 3 cops didn’t know Leroy, the guy could get down with the best of them. Don’t know all the facts and neither does ANYONE who’s posting on this forum unless you were there. The only thing we can really do is question. I do agree with the the question of, “if he was found unresponsive, why was there no paramedic called.” That should be the standard procedure in any suspected dui case resulting in injury despite the crime which has not yet been proven. Do I believe that Leroy could have fought the cops, yes. Do I believe that Leroy could have went for the gun, if there is truth to the warrant for his arrest I think if he were drunk it could cause any person to want to escape a damning position. But I don’t know the facts. Even the most heinous people have family members, Leroy was not heinous. For those of you who take up for Leroy can’t truly deny it may have gone down just as it did despite the lack of diligence taken for his state of being. For those condemning him, it’s easy to say good riddance but in a time where there have been some questionable calls always question authority because absolute power corrupts absolutely. My condolences to the fam, and my prayers to the police who may not have intended for that outcome but still had to do what they had to do.

The story states nothing about the deputies finding him unconscious, if you read it, it says the taco bell employees reported too 911 he was unconscious. Someone made a comment about not being handcuffed in the back seat, this is done so that the person and the officers are both in a safe environment, the cuffs go one once they have found evidence too arrest the suspect. In 2002 while in the Marines I had too shoot a man, not a day goes by that I don’t think about it, in the military and law enforcement, it is one of the hardest parts of the job, and no one ever wants to be put in that situation, on till the day you are put in that situation which I hope never comes, you have no idea what goes on when your life is on the line, instead off bashing the sheriff, LAPD and so on how about you do community policing so this crap ends. If you see wrong doing going on stand up for your neighborhoods, towns, and communities one person may not make a difference but a group can get the job done.

Asking someone to get out of the roadway isn’t the issue. Starting a confrontation with a pedestrian by offering him your own car door to use as a weapon is poor procedure and is something only a cop trained in “oh well, if things go bad I can shoot my way out and my badge will protect me from consequences” would do.

Crime is down in Palmdale. To suggest that this is “thanks to the deputies” is to suggest that they are somehow doing a BETTER job than they were before. Any suggestions how that might be so?
If you want to credit the reforms that the feds have forced upon the LACSD in the past couple years, I might buy that. If you want to credit the new sheriff trying to clean up the mess he inherited when he took the job, I might buy that.
But mostly I think it is due to improving economics. I’m also absolutely certain that roadside executions for drunk drivers is not going to have any positive effect.

Medically speaking according to what the police said he was unconscious when they found him, he was awakened from being unconscious after running into the wall at Taco Bell.
If this is true he could had quit possibly had a concussion and was startled when he was awaken. The claim is DUI, however no mention of toxicology screen or sobriety testing. No paramedics called. This young man was cuffed and handled. This just smell of unfairness doesn’t matter if he was black he was denied his rights.

It was in his vehicle because he was passed out from the alcohol and maybe marijuana when they apprehended him. Had he been awake that gun may have been used. I think the gun matters in this case a lot more than you think or wish to believe. Always so narrow minded people can be. A slim scrawny 135 lbs max 5’3″ with shoes on man that was shot 9 times after crashing and being reported unconscious by Taco Bell employees when they called 911. Why was he taken out of of the vehicle? Why was he not cuffed right away and he has a full frontal and back brace from a prior injury, and he was reported unconscious, why was he moved by non medical personnel. For the past 2 mths I was working in the ER and many DUI suspected drivers came in with minor injuries and DUI blood verification done in the ER NOT feild sobriety. How can a previously injured scrawny short man take on 3 police officers??? Resulting in 9 fatal bullets!! What… never heard of a frontal cortex injury that would result in mental derangement??? Was a little man that threatening??? Difference between Canada and USA police force is in Canada they are educated, well trained and encouraged to upholding the peace, not trained with fear and so called “A” type personality. A person sworn to wear a badge and gun to uphold the law is not a judge and should not be trigger happy! I just had this discussion! With the First year respiratory, I pulled up police requirements for Las Vegas and all it is GED or HIGH SCHOOL! Not Baccalaureate or Masters HIGH SCHOOL! Plus they can’t have more than 2 DUIs… What not 1 but 2 DUI but heaven forbid they have a domestic dispute charge that is the only disqualifying factor besides credit. I totally agree. Sorry he lost his life, but had he NOT been drinking and driving this might not of happened. I am law abiding citizen and have NEVER had a run in with the deputies. Think about that….Follow the laws, no problems. IRONIC!! When someone dies families have to justify their pain by putting blame on someone, not clearly thinking and accepting accountability. Policemen, Firemen, Paramedics, all in. any type of Emergency professionals have to make a quick choice when a perpetrator is going to kill that said professional. Those are all subsequent to the crashing of the car. And at least partly the responsibility of other parties. His contribution that he is solely responsible for was crashing the car, his outcome being shot dead.
Cops routinely play the dangerous game of confrontation because they know that they can shoot their way out without consequences.

It isn’t just the ones who somehow get caught. I sat and watched a cop perjure himself to make a traffic ticket stick, which I really didn’t expect. I just thought that committing perjury was a big enough thing that no one would do it over such a trivial matter.
Afterwards, I told more than a few people the story. EVERY time these people, who are certainly more supportive of law enforcement than me and represent a pretty wide selection of normal, law abiding, mostly conservative Republican, solid folks just looked at me like I was some kind of idiot. “Of COURSE they would commit perjury to make a traffic ticket stick. They do that all the time. EVERYBODY knows that!”

If this story is true, he was guilty of DUI and resisting arrest and some monetary damage charges. Last i checked, the penalty for these three charges is not death. Maybe the officers should have been better trained than to allow a drunk man who was passed out when they arrived to have access to their gun. Like maybe handcuff him while he was still passed out and administer a breathalizer to verify the DUI. At the very least, a baton or surely a stun gun would have subdued him and allow him to face proper penalties for his crimes.
