A veteran Los Angeles County firefighter has settled his lawsuit against his employer in which he alleged he was wrongfully denied a promotion to engineer in 2020 because he is Cuban, Catholic and made the sign of the cross in front of his evaluators, a county attorney told a judge on Thursday, April 6.
In light of the announcement of the accord during Thursday’s status conference, Los Angeles Superior Court Judge Anne Richardson canceled the scheduled Sept. 19 trial date of plaintiff Robert Villa‘s case. Filed in May 2021, Villa’s lawsuit alleged discrimination based on ethnicity and religion, as well as failure to prevent discrimination. The settlement terms were not divulged.
In their court papers, defense attorneys denied Villa’s claims and said the county had no liability. The same lawyers also said any conduct that Villa complained of was a “just and proper exercise of management discretion, undertaken for a fair and honest reason.” According to Villa’s lawsuit, he took the engineer examination in 2020 and passed the more difficult portions of the test, including the hydraulic, draft and brake portions.
“Prior to commencing his test, Villa, a devout, practicing Roman Catholic, did the sign of the cross, which was viewed by his raters,” the lawsuit stated.
One of the evaluators was a white captain and the second was an engineer who Villa does not believe to be Cuban, according to the suit.
Villa alleged that during the test, the raters discriminated against him by subtracting points for not pushing a button on the auxiliary braking device to operate the transmission retarder while only taking away two points from two white, non-Cuban applicants who made the same mistake. The only apparent difference between the two white, non-Cuban firefighters and Villa was that Villa was Cuban and Catholic, the suit stated.
Villa also was penalized points for going 44 mph in a 50 mph zone, even though the evaluators’ notes showed he was not impeding traffic or going too slow, according to his complaint. The evaluators also improperly deducted points on 11 separate occasions on the portion of the exam dealing with the vertical clearance of bridges, the suit alleged.
“The cumulative effect of these inappropriate deductions was that the raters failed Villa on the engineer examination. In doing so, the raters favored Caucasians and other non-Cuban, non-Catholic candidates and held it against Villa for doing the sign of the cross before starting the test,” the suit alleged. Villa has experienced financial damage as well as emotional distress as a result, according to his court papers.
“He has suffered for this huge setback in his career, a career choice he made so he could serve the public and help the members of the community he serves as a member of the (Los Angeles County Fire Department),” the suit stated.

why not just study a little harder and take the test again!!

‘Study harder’ doesn’t necessarily work when the test is not objective. If there is proof that this guy got marked down more for the same mistakes that other test takers got marked down less for than it is up to the people who administered the test to justify their scoring. I’m guessing there probably is proof of that, and also guessing that the test administrators could not come up with anything other than ‘well we didn’t like him so we dinged his score harder but we can’t really explain why we didn’t like him…but we flatly deny that the reasons we cannot explain involve discrimination.’ As soon as the county figured out that was going to be the defense they were stuck with they settled, for good reason.

Lol guy has the most coveted civil service job, where every fireman has the opportunity to become RICH, yet he still sues . Ungrateful man. Took the test for LA County fire 15 years ago. There was over 30000 people to test from every corner of the globe. Never knew it was such a lucrative career until that day.
